1. In these Terms, the following words and phrases carry the following meanings throughout:
‘Booking’ means Your booking of a Stay.
‘Damages’ means the costs to Us of making good any damage, losses, breakages or breaches of these Terms for which You are responsible pursuant to clause 10.
'Deposit' means the non-refundable deposit of 25% of the Price payable by You to secure a Booking.
‘Price’ means the price payable by You in respect of your Booking.
‘Stay’ means Your holiday at The Wash House, Peggy Hill, Ambleside, Cumbria.
‘Terms’ means these terms and conditions.
‘Us’ or ‘We’ or ‘Our’ means Joanna Hynes, William Froggatt and Steve Walker trading as Golden Rock Holidays.
‘You’ or ‘Your’ means the person or people making the Booking.
2. When We accept Your Booking in accordance with clause 5 below, a legally binding contract arises between You and Us on these Terms. We can enforce these terms on a joint and several basis.
3. The Terms can be varied at any time by written agreement between You and Us.
4. You can make a request for a Booking by contacting us directly and letting us know the dates which You want to book.
5. We will then contact You to confirm the Price and whether your Booking is accepted. We will send You a copy of these Terms at that time. If You proceed with the Booking (whether expressly in writing, or impliedly, for example by paying some or all of the Price), a legally binding contract arises between You and Us on these Terms. If Your Booking is not accepted for whatever reason or if You do not wish to proceed after receiving these Terms, no legally binding contract arises between You and Us.
6. If Your Stay is due to commence eight weeks or less after Your Booking is accepted, You must pay the Price in full within seven days of Your Booking being accepted. If Your Stay is due to commence more than eight weeks after Your Booking is accepted, You must pay a deposit equivalent to 25% of the Price within seven days and the balance no later than the day falling eight weeks before the Stay is due to commence. If You do not pay the Price (or any part of it) by the due date, Your Booking will be deemed to have been cancelled by You. We shall be entitled to retain the deposit (if one was paid) and We will be free to accept a Booking for those dates from someone else.
7. You can cancel your Booking at any time by contacting us via email. Your cancellation will only be effective from the point that We receive notification of it.
8. If You cancel more than five days before the Stay is due to commence, the Price will be refunded in full (including any deposit). If You cancel five days or less before the Stay is due to commence, We shall be entitled to retain the Price.
9. If You are in breach of these Terms, We may cancel the Booking. If We so cancel, We shall be entitled to retain the Price (including any deposit paid pursuant to clause 6). If We are obliged to cancel the Booking for any other reason, We will refund you the Price in full within seven days (including any deposit paid pursuant to clause 6).
10. We shall be entitled to recover from You the full cost of all Damages caused by You during the Stay (which includes any Damages caused by any other person in your party or any pet or any person other than Us who you allow to enter The Wash House).
11. No naked flames are permitted inside The Wash House other than matches used to light the woodburning stove. No smoking is permitted inside The Wash House although You may smoke outside provided you use an ashtray and remove all cigarette or cigar butts.
12. Pets are only be permitted by advance arrangement with Us.
13. The maximum number of people who may occupy The Wash House during the Stay is two adults.
14. The Stay will commence at 1500 on the first day of the Stay and end at 1000 on the last day of the Stay. You must leave no later than 1000 on the last day of the Stay. You must leave The Wash House in a clean and tidy condition.
15. We may access The Wash House during the Stay upon reasonable notice with Your permission. We may access The Wash House during the Stay without seeking Your permission in the case of emergencies or where We reasonably suspect a breach of these Terms.
16. We shall not be liable to You for any loss or damage (including any indirect or consequential loss and also including any costs and expenses) howsoever caused save for any death or personal injury caused through Our negligence. You agree that You use the garden and grounds, furniture and equipment at The Wash House at Your own risk.
17. We shall not be liable for any breach of these Terms where We are prevented from carrying out any obligation imposed on Us by something which is beyond Our reasonable control, including compliance with any government restriction.
18. No party other than Us and You shall acquire any rights under these Terms or be able to enforce these Terms as though they were a party to them.
19. Any disputes between You and Us shall be settled exclusively in accordance with English law and the English courts shall have exclusive jurisdiction.
